You agree to use our website and services for lawful purposes only and in accordance with this Agreement. You agree not to provide false or misleading information during consultation or service provision, use services for any unlawful or prohibited purpose, interfere with or disrupt our website or services, or attempt to gain unauthorized access to our systems or other users' information. You acknowledge and agree that our relationship is professional peer support, not clinical treatment, services are supplemental to, not a replacement for, clinical care when needed, we maintain professional boundaries consistent with peer support standards, and emergency situations require contacting appropriate emergency services. If you are participating in court-ordered programs, treatment requirements, or other mandated recovery activities, you are responsible for informing us of any reporting requirements, ensuring our services meet your program compliance needs, and obtaining necessary approvals for participation in our services.
4. BOOKING, CANCELLATION, AND PAYMENT TERMS
All services require advance booking through our website or by phone. Consultations are subject to availability and must be scheduled at least 24 hours in advance. Virtual services require appropriate technology and internet connectivity. Transportation services require 24-48 hours advance notice when possible. Client cancellations require 24-hour advance notice for session cancellations. Sessions cancelled with less than 24 hours notice may be charged at full rate. Failure to attend scheduled sessions without notice will be charged at full rate. We will provide reasonable notice for cancellations on our part. Service packages are billed monthly in advance, with payment due on the first of each month for the upcoming service period. Late payments may result in service suspension after 10 days past due. Add-on services are billed separately and due upon service completion. All payments are processed through secure third-party payment processors. Refunds for unused services may be available on a prorated basis. We will work to resolve service concerns before considering refunds. Refunds may be available for documented emergency situations. Approved refunds will be processed within 7-10 business days.
5. CONFIDENTIALITY AND PRIVACY
We maintain strict confidentiality of all information shared during our professional relationship, consistent with federal confidentiality regulations (42 CFR Part 2) when applicable, California state confidentiality laws, professional ethical standards for peer support services, and our Privacy Policy (incorporated herein by reference). Confidentiality may be limited when disclosure is required by law or court order, when there is imminent danger to your safety or the safety of others, when you provide written consent for information sharing, or for legitimate business purposes such as billing and scheduling. Our services are not designed for crisis intervention. In emergency situations involving imminent danger, we may need to contact emergency services (911), mental health crisis teams, law enforcement when necessary for safety, or your emergency contacts when appropriate.
6. LIMITATION OF LIABILITY AND DISCLAIMERS
You acknowledge and agree that our services are peer support and coaching, not clinical treatment, we do not diagnose, treat, or cure any medical or mental health conditions, services are not a substitute for professional medical or clinical care, and individual results may vary, and we cannot guarantee specific outcomes. To the maximum extent permitted by law, our total liability shall not exceed the amount paid for services in the preceding 12 months, we are not liable for indirect, incidental, special, or consequential damages, we are not responsible for outcomes resulting from your decisions or actions, and our liability is limited to the direct cost of services provided. Website content is provided "as is" without warranties of any kind. We do not guarantee uninterrupted website availability or functionality. 9. DISPUTE RESOLUTION
Before initiating formal legal proceedings, we encourage informal resolution through direct communication with your assigned peer support specialist, discussion with our management team, or mediation through a mutually agreed upon mediator. This Agreement is governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings must be brought in the appropriate courts of California.
